Omaha Municipal Code prohibits discrimination because of race, color, creed, religion, national origin, age, sex, disability or marital status in connection with employment, housing, and public accommodation (bars, restaurants, hotels, etc.).

Filing a Charge

If you believe you are the victim of discrimination by any other party whether an individual, a company, a group or an agency, you should contact the Human Rights and Relations Department as soon as possible after you learn of the discriminatory act.

A person does not need an attorney to file a complaint or be represented through the OHRRD's investigation or hearing procedures.  However, individuals do have a right to be represented by an attorney at their own expense, if they so choose.


Start the Filing Process

Employment and Public Accommodation charges must be filed within 180 days of the alleged act of discrimination.  Housing charges must be filed within 365 days of the alleged act of discrimination.  Click on the appropriate link below to start the filing process:

Retain any receipts, forms, records or other documents to help substantiate your charge.

A representative of the Human Rights and Relations Department will assist you in filing your charge which you must sign under oath or affirmation.

After You File

An investigator of the Human Rights and Relations Department will investigate your charge and gather the evidence needed to determine if unlawful discrimination occurred.

If unlawful discrimination is found, the Human Rights and Relations Department will try to resolve the matter through conference, conciliation or persuasion.  If these methods are unsuccessful, the Human Rights and Relations Department will initiate a hearing before the Civil Rights Hearing Board.

If the Human Rights and Relations Department or other party (i.e. company, individual) disagree with the Civil Rights Hearing Board's decision, the Department or the other party may appeal the case to the district court.

If no unlawful discrimination is found, the Human Rights and Relations Director will administratively dismiss your charge.  You can then request a reconsideration by the Human Rights and Relations Board.  To request a reconsideration you must:

• Submit a written request which contains a brief statement of the reasons for the request and any new evidence in support of the request; and,

• Mail or deliver the request to the following: The Human Rights and Relations Director, the person against whom you filed the charge and the Chair of the Human Rights and Relations Board within ten (10) days from the date that you receive the notice.

To achieve best results the Department needs:

• YOUR COOPERATION.  You must help us develop the case since you are more familiar with it than we are.  You must tell us the facts as they are, even those facts which may weaken the case.  You must answer all your questions honestly and completely.

• YOUR TRUST.   We will make every effort to conduct a thorough investigation to determine the true facts in the cases as quickly as possible.  We keep all information confidential.

El Código Municipal de la Ciudad de Omaha prohibe discriminación a base de raza, color, credo, religión, origen nacional, edad, sexo, impedimento físico o estado civil en conexión con el trabajo, viviendas y acomodaciónes públicas (bares, restaurantes, hoteles, etc.).

Registrar una Queja

Si usted se cree víctima de discriminación de parte de alguien, sea un individuo, una compañía, un grupo o agencia, usted debe comunicarse con el Departamento de Derechos y Relaciónes Humanas tan pronto como le sea posible después de que el evento discriminatorio haya ocurrido.  Si usted quiere registrar una queja por favor llámenos lo mas pronto posible.  Nuestro Número de teléfono es 402-444-5055.

Quejas de Empleo y Acomodaciónes Públicas deben ser registradas dentro de 180 días a partir del día que usted fue discriminado.  Quejas de viviendas deben ser registradas dentro de 365 días a partir del día que usted fue discriminado.

No se necesita un abogado para registrar una queja o para ser representado por el Departamento de Derechos y Relaciónes Humanas.  Sin embargo, individuos tienen el derecho de ser representados por un abogado a su propio gasto, si ellos eligen.

Un representante del Departamento de Derechos y Relaciónes Humanas le asistirá en registrar su queja.  Se requiere que usted firme la queja bajo juramento.

Después de Rejistrar

Un investigador del Departamento de Derechos y Relaciónes Humanas investigará su queja y recogerá la evidencia necesaria para determinar si discriminación ilegal ocurrió.

Si se encuentra discriminación ilegal, el Departamento de Derechos y Relaciónes Humanas tratará de resolver el caso por medio de conferencia, conciliación, o persuasión.  Si estos métodos no son exitosos, el Departamento de Derechos y Relaciónes Humanas iniciará una audiencia delante la Junta de Audiencia para los Derechos Civiles.

Si el Departamento de Derechos y Relaciónes Humanas o la otra parte (ejemplo: la compañía o individuo) no están de acuerdo con la decisión de la Junta de Audiencia para los Derechos Civiles, el Departamento o la otra parte pueden apelar el caso ante la Corte del Distrito.

Si no se encuentra discriminación ilegal, el/la Director(a) del Departamento de Derechos y Relaciónes Humanas descartará su queja administrativamente.  Usted puede pedir una reconsideración a la Junta de Relaciónes Humanas.  Para pedir una reconsideración, usted debe:

• Someter una petición escrita conteniendo una declaración breve describiendo las razónes para la petición y cualquier nueva evidencia que apoye su petición; y,

• Enviar por Correo o entregar la petición a las siguientes personas: Director del Departamento de Derechos y Relaciónes Humanas; a la persona contra quien usted registró la queja y al Presidente de la Junta de Relaciónes Humanas dentro de diez (10) días a partir del día en que usted recibió su notificación.

Para obtener los mejores resultados, el Departamento necesita de usted:

• Su Cooperación - usted debe de ayudarnos en desarrollar su caso ya que usted esta más familiarizado con su caso que nosotros.  Usted debe decirnos todos los hechos como ocurrieron, hasta esos detalles que puedan debilitar su caso, y conteste todas nuestras preguntas de manera honrada y completamente.

• Su Confianza - Nosotros haremos todo lo posible para conducir una investigación detallada y determinar los hechos correctos en el caso tan pronto sea posible.  Mantendremos toda la información confidencialmente.
