The City is a "municipal corporation" - a governmental entity created by state statute. As such, its power to act is circumscribed by the Omaha Home Rule Charter, the statutes of the State of Nebraska, the Nebraska State Constitution, and the United States Constitution. In its governmental capacity, the City legislates as well as implements and enforces legislation for the welfare of the citizens of Omaha. In many respects, the City is organized like a private corporation. Just as a corporation acts through its Chief Executive Officer, the City acts through its Mayor. The City Council is similar to a corporate board of directors, meeting regularly to set policy and make decisions. Like many corporations, the City is organized into several departments that perform different functions. It is the City's status as a governmental entity that presents the greatest challenge to the lawyer representing it. |
