Area Source MACT

Section 112 of the Clean Air Act mandates the EPA to develop regulations for sources which emit Hazardous Air Pollutants (HAPs). These Hazardous Air Pollutants are chemicals that are known to cause cancer or other serious health effects, or adverse environmental effects. The EPA has identified 187 such HAPs. A key component of the EPA’s regulation programs for HAPs is the National Emissions Standards for Hazardous Air Pollutants (NESHAP) for source categories, also known as MACT (Maximum Achievable Control Technology) Standards, codified in 40 CFR 63.

These standards include both major sources of HAPs (sources that emit greater than 10 tons per year (tpy) of any one HAP or 25 tpy of combined HAPs) and Area sources (sources that emit less than 10 tpy of any one HAP or 25 tpy of combined HAPs).

Under OMC 41-2 Chapter 28, the City of Omaha requires all facilities subject to an Area Source MACT Standard to submit an annual notification of compliance by March 31st of each year.
