Area Source Boilers
Industrial, Commercial, and Institutional Boilers Located at Area Sources

40 CFR 63 Subpart JJJJJJ covers existing and new industrial, commercial, and institutional boilers located at area sources of hazardous air pollutants (HAPs). Boilers covered under this rule are those that are fired by coal, biomass, or oil. Boilers fired by natural gas (or oil only during periods of gas-curtailment and/or testing) are not covered under this rule.
Affected sources under this rule are divided into several categories based on date of construction, boiler size (heat-input capacity), and fuel type. Each category has different compliance requirements, and may have different compliance dates. All affected sources are required to submit an Initial Notification to OAQC and EPA Region VII by November 17th, 2011 or 120 days after startup for new sources.
Source Classification
Existing: constructed or re-constructed on or before June 4th, 2010.
New: constructed, re-constructed, or became affected (i.e. switched from natural gas to coal, biomass, or oil) after June 4th, 2010.
Compliance Requirements
Existing Large Boilers (>= 10MMBtu/hr):
- Coal
- Numeric emission limits for 2 pollutants: Mercury and Carbon Monoxide
- 1-time energy assessment
Existing Small Boilers (<10MMBtu/hr)
- Biomass and Oil
- Tune-up every other year
- 1-time energy assessment
- Coal, Biomass, and Oil
- Tune-up every other year
New Large Boilers (>=10MMBtu/hr)
New Small Boilers (<10MMBtu/hr)
- Coal
- Numeric emission limits for 3 pollutants: Mercury, Carbon Monoxide, and Particulate Matter
- Biomass, Oil
- Numeric emission limit for 1 pollutant: Particulate Matter
- Tune-up every other year
- Coal, Biomass, and Oil
- Tune-up every other year
Compliance Dates
Existing
- Subject to tune-up: March 21st, 2012
- Subject to emission limits and energy assessment: March 21st, 2014
New: May 20th, 2011 or upon startup
Notification Dates
Initial Notification: November 17th, 2011 or 120 days after startup
Notification of Intent to Test: 60 days prior to testing
Compliance Notification
- Not required to test: 120 days after compliance date (see above)
- Required to test: 60 days after test
Compliance Report
All affected sources are required to submit a compliance report, either an annual or biennial report.
Annual Reports – For all sources with requirements beyond a biennial tune-up
- Must prepare by March 1st of each year
- Must submit upon request or if deviations submit by March 15th
Biennial Reports – For all sources subject to biennial tune-up only
- Must prepare biennially by March 1st
- Must submit upon request or if deviations submit by March 15th biennially  Â
